据新海南客户端、南海网报道，近日海南三亚有几家小卖部，因为售卖常用的风油精和创可贴被查，这是怎么回事呢？

据了解，为有效化解用药风险，及时排除隐患，今年4月以来，三亚市综合行政执法局第一行政执法支队在执法检查中，发现部分偏远地区小卖部、小超市经营者法律意识淡薄，存在未取得《药品经营许可证》经营风油精、创可贴等药品的行为，目前已对4家涉嫌未取得《药品经营许可证》经营风油精、创可贴等药品的小卖部立案调查。

标有“国药准字”号的风油精、创可贴属于药品，经营药品需要取得《药品经营许可证》，无证经营药品将依据《中华人民共和国药品管理法》相关规定给予行政处罚。消费者购买药品，需前往取得《药品经营许可证》的药店购买。

去年多地小店售卖

创可贴、风油精也被查

2023年5月，据浙江丽水市莲都市场监管局消息，有些小卖部、小超市为了方便居民，进购了一些创可贴来卖，虽然出发点是好的，但这种行为可能已经违法，已有两家超市因为卖创可贴被处罚。

2023年4月7日，莲都区市场监管局执法人员根据举报线索，对碧湖镇环北路某食品超市进行了检查，在该超市货架上发现“云南白药创可贴”，通过调取监控录像显示，该超市曾在近期向顾客销售“云南白药创可贴”。

同年4月24日，莲都区市场监管局执法人员对莲都区中山街某生鲜超市进行了检查，通过查询收银系统销售记录发现，该超市曾在近期向顾客销售“云南白药创可贴”。

上述两家超市无证销售“云南白药创可贴”的行为，构成未取得药品经营许可销售药品的违法行为。依据《中华人民共和国药品管理法》相关规定，决定对当事人的违法行为予以没收违法所得并处罚款的行政处罚。

2022年5月10日，据无锡市锡山区市场监督管理局消息，东港分局在对辖区某超市开展日常检查时发现，该超市的货架上正在销售某品牌的创可贴，该款创可贴外包装上明确标有“OTC”标志，属于乙类非处方药。经查，该超市并未取得《药品经营许可证》，涉嫌未取得药品经营许可证销售药品。东港分局对其进行立案调查。

不能为了方便丢了安全底线

可能有消费者会觉得，超市和小卖部方便顾客卖一点创可贴等日常用品，执法部门查处是不是有点小题大做了？

据市场监管部门介绍，这绝对不是小题大做，而是一条安全底线。因为没有《药品经营许可证》，这些商户无法从正规渠道购进药品，其售卖的药品存在安全隐患！

创可贴、清凉油、风油精、人丹、藿香正气水等是人们生活中常用的物品。但是，它们属于OTC类药品，不可随意销售。

依据《中华人民共和国药品管理法》第一百一十五条规定：未取得药品生产许可证、药品经营许可证或者医疗机构制剂许可证生产、销售药品的，责令关闭，没收违法生产、销售的药品和违法所得，并处违法生产、销售的药品（包括已售出和未售出的药品，下同）货值金额十五倍以上三十倍以下的罚款；货值金额不足十万元的，按十万元计算。

市场监管部门提醒，药品安全事关人民群众生命健康，经营单位应按规定取得《药品经营许可证》，要从有药品生产、经营资格的企业购进药品，进货时要严格建立和执行进货查验制度。

同时，消费者要选择医院、有资质的药店或者医疗器械零售店等正规渠道购买药品和医疗器械，线上购买时要重点查看电商商家资质，谨慎鉴别，不要在微信朋友圈、微信群等无法判断资质的渠道购买。

Currently, four vendors suspected of operating drugs such as Feng You Jing and Band Aids without obtaining a Drug Business License have been investigated.

Fengyoujing and Band Aids labeled with the "National Medical Approval Number" belong to the category of drugs. Trading drugs requires obtaining a "Drug Business License". Trading drugs without a license will be subject to administrative penalties in accordance with the relevant provisions of the Drug Administration Law of the People's Republic of China. In May 2023, according to the Liandu Market Supervision Bureau in Lishui, Zhejiang, some small shops and supermarkets purchased some band aids to sell for the convenience of residents. Although the intention was good, this behavior may have been illegal, and two supermarkets have been punished for selling band aids.

On April 7, 2023, law enforcement officers from the Liandu District Market Supervision Bureau conducted an inspection of a food supermarket on Huanbei Road in Bihu Town based on reported clues. They found "Yunnan Baiyao Band Aids" on the shelves of the supermarket. According to surveillance footage, the supermarket had recently sold "Yunnan Baiyao Band Aids" to customers.

On April 24th of the same year, law enforcement officers from the Market Supervision Bureau of Liandu District inspected a fresh supermarket on Zhongshan Street in Liandu District. Through checking the sales records of the cash register system, it was found that the supermarket had recently sold "Yunnan Baiyao Band Aids" to customers.

The behavior of the two supermarkets selling Yunnan Baiyao Band Aids without a license constitutes an illegal act of selling drugs without obtaining a drug business license. According to the relevant provisions of the Drug Administration Law of the People's Republic of China, it is decided to impose administrative penalties of confiscating illegal gains and imposing fines on the parties involved for their illegal acts.

On May 10, 2022, according to the Market Supervision Administration of Xishan District, Wuxi City, the Donggang Branch found during daily inspections of a supermarket in its jurisdiction that a certain brand of band aids was being sold on the shelves of the supermarket. The outer packaging of the band aids was clearly marked with the "OTC" logo and belonged to Class B over-the-counter drugs. After investigation, the supermarket has not obtained a Drug Business License and is suspected of selling drugs without a Drug Business License. The Donggang Sub bureau has initiated an investigation into it.

We cannot lose the safety bottom line for convenience

Some consumers may think that supermarkets and small shops are convenient for customers to sell daily necessities such as band aids, and law enforcement agencies may be making a big deal out of it?

According to market regulatory authorities, this is definitely not a big deal, but a safety bottom line. Due to the lack of a Drug Business License, these merchants are unable to purchase drugs from legitimate channels, and the drugs they sell pose safety hazards!

Business units should obtain a Drug Business License in accordance with regulations, purchase drugs from enterprises with drug production and business qualifications, and strictly establish and implement a purchase inspection system when purchasing.

At the same time, consumers should choose legitimate channels such as hospitals, qualified pharmacies, or medical device retail stores to purchase drugs and medical devices.
