一段时间以来，国内短视频平台上的“俄罗斯美女”越来越多。镜头里的她们美丽、大方、开放，迫切地想要嫁到中国，不收一分钱彩礼……但这些所谓的“俄罗斯美女”，只不过是一群由AI（人工智能）生成的面孔而已。据了解，“俄罗斯美女”的粉丝，以中老年男性居多。

“俄罗斯美女”背后的账号运营者，贩卖着风情和情怀，眼里实则只有钱。对于他们来说，用AI生成的“俄罗斯美女”不过是其获利的道具。今天“俄罗斯美女”好用，就用它；哪天“俄罗斯美女”不好用了，就再换一个别的名目。

而与流量收益相比，AI技术的不断发展，让制造“俄罗斯美女”的成本极为低廉。可以预见的是，如果不加以遏制，恐有更多人涌入这一赛道，试图从中分一杯羹。

然而，假的终究是假的。风情万种的AI美女背后，可能是油腻的中年大叔；巨额粉丝、巨大流量、销量，也不过是人为误导产生的虚假繁荣。一句话：这是欺骗的结果。而那些被AI美女不断收割的人，则是直接受害者。

他们中的一些人不知道AI为何物，甚至在平台标注“视频系AI生成”后，仍相信确有其人，让人同情的同时又“恨其不争”。但没有哪个人受骗是天经地义的，“不知”和轻信，不是任何人欺骗他们的理由。

从AI生成的“俄罗斯美女”账号运营者的行为来看，虚构事实，让他人陷入认识错误从而甘愿掏腰包，显然具有欺骗性质。这在道义上可究，但是否构成法律意义上的民事欺诈，甚至刑事诈骗，则不可一概而论。

从个体角度看，如果有人有证据证明，自己付出钱财系因对方欺骗所致，不排除运营者构成民事欺诈甚至刑事诈骗的可能。但从针对所有网民的整体角度看，除非有特殊情况，否则，作出民事欺诈和刑事诈骗的认定应慎重。

法律手段治理难有作为，不意味着AI生成的美女可以不受约束地大行其道。包括行政手段在内的其他方式，也足以让其回到规范轨道。

今年4月，中央网信办开展“清朗”专项整治行动。针对数字人和虚拟技术的泛滥，明确要求使用AI等技术生成信息的，必须明确标注系技术生成。如果上述规定能够得到切实执行，AI生成“俄罗斯美女”的乱象即便不能绝迹，也会好转很多。

但对于短视频运营者来说，如果各方积极落实中央网信办规定，让更多人知晓真相，他们因欺骗获利的空间就小了。因为这样的原因，一些人可能会有打“擦边球”的努力。

标注短视频系技术生成，这是硬要求，没有讨价还价的余地。但标注在不显著的地方，字号尽量小一些，让尽可能少的人看到，却可能成为他们“努力”的方向。对此，短视频平台应严格履行平台责任，对于标注来源、位置、字号等作出明确规定，确保相关规定得到贯彻执行。

AI技术发展迅速是一把“双刃剑”，在带来发展机遇的同时，也带来了相应的挑战。而AI生成的“俄罗斯美女”泛滥，就是一个挑战。治理好这种乱象，不让AI生成的“俄罗斯美女”掏空一些人的钱包，显然需要各方共同努力。

In one sentence: This is the result of deception. And those who are constantly being harvested by AI beauties are the direct victims.

Some of them do not know what AI is, and even after labeling it as "video AI generated" on the platform, they still believe that there is a real person, which is sympathetic but also "resentful". But it is only natural for no one to be deceived, and being ignorant and gullible is not a reason for anyone to deceive them.

From the behavior of the operator of the "Russian Beauty" account generated by AI, it can be seen that fabricating facts and causing others to fall into cognitive errors and willingly pay for them clearly has a deceptive nature. This can be investigated morally, but whether it constitutes civil fraud or even criminal fraud in the legal sense cannot be generalized.

From an individual perspective, if someone has evidence to prove that their payment of money was due to the other party's deception, it cannot be ruled out that the operator may constitute civil or even criminal fraud. However, from the overall perspective of all netizens, unless there are special circumstances, the determination of civil fraud and criminal fraud should be made with caution.

The difficulty of legal means to govern does not mean that AI generated beauties can thrive without constraints. Other methods, including administrative measures, are also sufficient to bring it back to a standardized track.

In April of this year, the Central Cyberspace Administration launched a special campaign to rectify the "cleanliness". In response to the proliferation of digital humans and virtual technology, it is necessary to clearly label the use of AI and other technologies to generate information. If the above regulations can be effectively implemented, even if the chaos of AI generating "Russian beauties" cannot disappear, it will still improve a lot.

But for short video operators, if all parties actively implement the regulations of the Central Cyberspace Administration and let more people know the truth, their profit margin from deception will be limited. For this reason, some people may make an effort to play the edge ball.

The generation of annotated short video series technology is a mandatory requirement and there is no room for bargaining. But in inconspicuous places, the font size should be as small as possible to be seen by as few people as possible, but it may become their direction of effort. In this regard, short video platforms should strictly fulfill their platform responsibilities, make clear provisions for labeling sources, locations, font sizes, etc., and ensure that relevant regulations are implemented.

The rapid development of AI technology is a double-edged sword, bringing both development opportunities and corresponding challenges. The proliferation of "Russian beauties" generated by AI is a challenge. Managing this chaos well and preventing AI generated "Russian beauties" from emptying some people's wallets clearly requires joint efforts from all parties.
